Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

This website is operated by EvanRuby LLC. Throughout the site, the terms “we”, “us” "EvanRuby", "the artist" and “our” refer to EvanRuby LLC and Graphic Design Artist Carolyn McGlown and any agents or assigns. We offer this website, including all information, tools and services available from this site to you the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

We reserve the right, but are not obligated, to limit the sales of our products and services to any person, geographic region or jurisdiction. We reserve the right to limit the quantities of any products that we may offer and to discontinue any product at any time, effective immediately upon posting on this Site. All prices are in USD with payments processed through various payment providers such as VISA, Mastercard, American Express, etc.

Occasional typos or mistakes in product details, prices, promotions, shipping info, and availability may occur. We're committed to fixing any errors noted. We do not authorize the purchase of our merchandise for resale purposes. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. We also reserve the right to limit or cancel orders which we deem, at our sole discretion, to be placed by dealers, resellers or distributors. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. We also reserve the right to cease doing business with those customers violating this policy. We may modify this policy at any time without prior notice. This policy applies to all purchases made on our online store. NOTE: We reserve the right to correct, update or change information regarding this policy at any time without notification.

However, you should not provide a link which suggests any association, approval or endorsement on this websites part in respect to your personal social media pages, business or website, unless the artist has expressly agreed to this in writing. The artist may withdraw consent to your linking to this website at any time by written notice to you.

SECTION 9 - LIMITATION OF LIABILITY/CONFIDENTIALITY

All personal information site visitors provide will be dealt with in a confidential manner in accordance with the Privacy Policy. However, due to circumstances outside of the artists control, there is no guarantee that all aspects of your use of the EvanRuby company website will be confidential due to the potential ability of third parties to intercept and access such information.

SECTION 10 - ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, at our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel and order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was placed. This includes our right to limit or prohibit orders that, in our sole judgement, appear to be placed by dealers, resellers or distributors.

Customer relationships with the electronic payment processors (Visa, MasterCard, American Express, Etc.) is separate from your relationship with the EvanRuby company and is governed by their terms and conditions contained in your credit card agreements. The EvanRuby company is not responsible for the actions or omissions of any third party payment processor.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we may complete your transactions and contact you as needed.

SECTION 11 - INDEMNIFICATION, DATA RETENTION ACCOUNT MANAGEMENT AND TERMINATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless EvanRuby LLC and its agents against any and all claims, damages, obligations, losses, liabilities, costs, and expenses, including reasonable attorney fees, arising from or related to your use of the EvanRuby company website/store and its services. EvanRuby LLC shall not be held liable for any damages resulting from purchased products. Customers assume all risks associated with the use of products.

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us in writing to delete this information.

In addition to all other rights provided to EvanRuby LLC under these Terms, we reserve the right, in our sole discretion, to take any of the following actions at any time and without prior notice:

(ii) restrict or block your future access to and use of the site or its services;
(iii) refuse service; or
(iv) cancel any orders placed.
